Terms and Conditions ShakeXperience Competition 2014

The following terms and conditions apply to the online questionnaire which is organized by ShakeXperience. ShakeXperience is a company that makes teaching and learnning fun and fast through arts, the purpose of this competition if for the company to collect data for purposes of Market Research and later marketing correspondence.


  1. You the 'User'.
    1. You (the “User”) must comply with the terms and conditions set out in this agreement (the “User Agreement”) in your use of this web site. You must be at least 18 years of age (or meet the minimum legal age and any other requirements to enter into legal agreements in your particular jurisdiction) to enter the competition. By entering this competition and by agreeing to these terms (“Terms”), you warrant and represent that you are at least 18 years of age.
    2. These Terms are provided in the English language only, and we have no control over any third party translations. We do not warrant the accuracy, reliability or timeliness of any information translated by any third party translation service and will not accept liability for loss incurred as a result. Some files, and other items cannot be translated including but not limited to graphical buttons, drop down menus, graphics, and photos. In addition, some applications and/or services may not work as expected when translated.
  2. Registration.
    1. To participate in the ShakeXperience competition, participants are required to register at the website http://www.shakexperience.com/teachers/ by providing all information required in the online questionnaire. Participants can also download the form and mail or email it back to ShakeXperience (contact details are provided on the form).
    2. Participants are required to ensure that the information provided to ShakeXperience for registration of the competition is valid, complete and accurate. In the event that such information is found to be invalid, incomplete and inaccurate, the participants will automatically be disqualified from ShakeXperience Competition.
    3. Participants are required to inform ShakeXperience of any changes to the information provided to ShakeXperience in accordance with the provisions of paragraph 1(a) above prior to the Closing Date (as hereinafter defined) by email to bookings@shakexperience.com
  3. Eligibility for ShakeXperience Competition
    1. ShakeXperience competition is open to all schools in South Africa.
    2. Each school is represented by the representative filling the form. The form must be filled by any employee in a school of South Africa (teacher, principal, admin staff etc), who is at least 18 years of age at the time of participation. Parents or learners are not eligible to enter the Competition.
  4. Other Conditions of Participation.
    1. Participation in ShakeXperience competition shall be via the Internet or via mail before 10th December 2014 at midnight ("End Date"). All entries for ShakeXperience competition must be submitted to ShakeXperience via the website, mail or email before the 10th of December 2014 at midnight.
    2. Participation in the competition does not depend on the purchase of any merchandise, the use of any non-gratuitous services and/or the payment of any charges and/or user fees to ShakeXperience.
  5. Details and Conduct of ShakeXperience Competition.
    1. Actual group participants of the competition will be determined solely by a lucky draw and the selection and requirements made out by ShakeXperience’s discretion.
    2. At the selection, ShakeXperience may draw reserve participants to replace any Research Group member subsequently disqualified.
  6. Notification of Winners and Prices.
    1. The winners of the competition will be announced on ShakeXperience facebook page on the 8th January 2015. They will be called individually on the same day to be communicated the results.
    2. The first prize is a 3-hour workshop to the value of R10 000 as well as an airtime voucher worth R500. The second price is a 2-hour workshop to the value of R7500. The third prize is an airtime voucher worth R750.
    3. The airtime will be sent to the individual who filled the questionnaire. The workshop will be for all teachers of the school registered as well as a grade of learners preferred by the teacher. 
    4. The airtime will be sent to the winners before the 31st of January. Workshops will be scheduled at the school's convenience.
  7. Privacy Policy.
    1. By providing ShakeXperience with personal information, the participants signify that he or she agrees that ShakeXperience will be sending information to the contacts provided about the educative products and offerings of the company. If you do not agree this term, please do not provide any personal information and do not enter the competition.
  8. Third Party Advertisers and Marketers.
  9. When you submit your Personal Information to us by way of our website or email, for example by completing a registration or questionnaire form, or a portion of the Personal Information. We WILL NOT submit any form or part of your Personal Information to advertisers or any other marketing company. Accordingly, by using our website and by submitting the Personal Information, you are agreeing that we WILL NOT pass on any of the Personal Information you submit to any Third Parties.
  • Preservation of Intellectual Property Rights.
    1. Material from this website or from any other website owned, operated, licensed or controlled by us may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights held by the respective owners thereof. The use of any such material on any other web site, ftp server or network environment is prohibited.

    The following Privacy Policy applies to the competition which is organized by ShakeXperience. ShakeXperience is a company that makes teaching and learnning fun and fast through arts, the purpose of this competition if for the company to collect data for purposes of Market Research and later marketing correspondence.

    1. Unless otherwise stated relevant to specific data on any site related to ShakeXperience, the rights to all service data collected during the operation of the service related to the competition becomes the property of ShakeXperience as set out in these terms.
    2. Any personal information submissions by you to, or through the service will exclusively be stored and used by ShakeXperience and managers of the service to deliver the service to you in an efficient manner as set out in these terms.
    3. Any profile information submissions by you to, or through the service will be stored and used by ShakeXperience and managers to tailor the existing and future service and content delivered or to be delivered through the service to you more relevantly, effectively and efficiently as set out in these terms.
    4. Certain public information may be obtained, stored and used by ShakeXperience and managers of the service based on your interactions on questionnaires related to the service through various devices, browsers, connections and carriers that forms part of enabling delivery of the service.
    5. ShakeXperience and managers retains the right to at its sole discretion, manipulate and translate any and all service data into a statistical information format for the purposes of publishing reports that can be made public to clients on a commercial, or non-commercial basis without any liability to you, provided no personal information directly identifying you as a user of the service is included.
    6. When you choose to contribute content to, or through the service, you do so entirely at your own risk and you grant ShakeXperience and managers of the service an unlimited license to use, modify, store, publish, share, distribute such content for commercial or non-commercial purposes with no liabilities, or obligation to ShakeXperience and managers of the service to remunerate you in any shape or form.
    7. Service data may be transferred across the national borders of your country of residence and stored in multiple international locations to make the service possible in accordance with the competition's legal terms of service, copyright and privacy policy. Additionally contributions made by you, may be published, transmitted or shared in any part of the world where the service is available in accordance with the general service terms.
    8. Reasonable efforts will be made by ShakeXperience and managers of the service to protect all service data obtained, stored and used, however in the event that the security of any service data may have been compromised you undertake to indemnify and hold harmless ShakeXperience, managers and all members, officers, servants, agents and duly authorised representatives of ShakeXperience of the service against all liabilities (including damages whether direct, indirect or consequential, expenses, costs and legal fees on an attorney and own client scale) actions, proceedings, claims and demands on all alleged claims and demands howsoever arising.
